Dance’s Sporting Goods – Terms of Use

Welcome to Dance’s Sporting Goods. By accessing or using this website and the Dance’s Sporting Goods mobile app (together, the “Site”), you agree to comply with and be bound by these Terms of Use. Please read them carefully before using the Site. If you do not agree with any part of these Terms, you may not use the Site.

1. Definitions

“Dance’s,” “Dance’s Sporting Goods,” “we,” “us,” or “our” refers to Dance’s Sporting Goods, Inc.
“You,” “your,” or “yours” refers to any person using or accessing the Site, including purchasers and browsers.
“Your Content” refers to any text, images, video, audio, or other material you post or submit on the Site.

2. Eligibility / Minors

You must be at least 18 years of age to use this Site.
Purchases of firearms, ammunition, or restricted products may require you to be 21 years of age depending on federal, state, and Dance’s Sporting Goods store policy (see Section 5).
The Site is not intended for minors or anyone under the legal age to purchase restricted products.

3. Account & Access

Certain areas of the Site may be restricted. We may limit or revoke access at any time, at our sole discretion.
Any usernames or passwords you receive are confidential. You are responsible for maintaining their confidentiality.

4. Restrictions on Use

You are prohibited from:

Republishing, copying, or distributing Site content on other websites or media.
Selling, sublicensing, or commercializing any Site content.
Using the Site in ways that interfere with other users’ access.
Engaging in data mining, scraping, or automated data collection without permission.
Posting unlawful, offensive, or infringing content.
Using the Site for unauthorized advertising or marketing.

5. Purchases & Store Policy

Firearms and Age Requirements:
- As a matter of Dance’s Sporting Goods store policy, tactical rifles and other restricted items (e.g., AR-10, AR-15, AK-47, SBRs, SBSs, AOWs, suppressors, and bullpup semi-automatic rifles) are sold only to individuals 21 years of age or older, regardless of any lower age that may otherwise be permitted under applicable federal or state law.
- All firearm purchases must comply with federal, state, and local laws, including all applicable waiting periods, background checks, and FFL transfer requirements.
Billing & Shipping Requirements:
- Billing and shipping names must match; mismatched orders will be cancelled and refunded.
- Orders over $100 may require signature confirmation upon delivery.
High-Capacity Magazines:
- Magazines exceeding local or state legal capacity may not be supplied, except where:
  - the receiving FFL dealer can legally accept them and convert to a compliant capacity;
  - the purchaser is a law enforcement officer with valid credentials and department authorization; or
  - the purchaser is a licensed FFL dealer.
In-Store Pickup:
- Orders marked for FREE In-Store Pickup must be collected within 30 days or may be canceled, refunded, and charged a 20% restocking fee.
- Orders mistakenly marked for pickup but intended for shipping will incur shipping charges before dispatch.
Inventory & Availability:
- Occasionally, items may show as in-stock online but have been sold in-store. In such cases, you will receive a full refund or store credit.

6. Shipping & Returns

Shipping is limited to the continental United States (lower 48).
We do not ship internationally, and shipping to Hawaii or Alaska requires calling (804) 526-8399 x104.
All sales of firearms or suppressors require FFL transfer or in-store pickup.

7. Product Descriptions & Images

Product descriptions, images, and titles are provided to the best of our knowledge and are intended to accurately represent each item.
Some variations may occur; we recommend verifying details with the manufacturer if needed.

8. Your Content

By submitting content to the Site, you grant Dance’s Sporting Goods a non-exclusive, worldwide, sublicensable license to use, reproduce, publish, adapt, and distribute it in any media.
Content must be your own and must not infringe on third-party rights. We reserve the right to remove any content at our discretion.
Photos and captions posted to the Brag Board in the mobile app are also subject to Section 23.

9. No Warranties

The Site is provided “as is” and “as available”, without warranties of any kind.
Dance’s Sporting Goods does not guarantee the accuracy of product information, availability, or functionality of the Site.
Product warranties are provided solely by the manufacturer. Please refer to the manufacturer for repair, replacement, or return under warranty.

10. Limitation of Liability

Dance’s Sporting Goods, its officers, directors, or employees are not liable for any damages arising from your use of the Site or purchase of products, whether direct, indirect, incidental, or consequential.
This limitation applies to all claims, including negligence and breach of contract, except as prohibited by law.

11. Indemnification

You agree to indemnify and hold harmless Dance’s Sporting Goods from any claims, liabilities, damages, or expenses arising from your breach of these Terms or misuse of the Site.

12. Force Majeure

Dance’s Sporting Goods is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, weather, carrier delays, strikes, pandemics, or government actions.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Virginia.
Any disputes will be resolved in the state or federal courts located in Virginia.

14. Proposition 65 – California Residents

WARNING: Firearms, ammunition, and related products sold on this Site can expose you to lead and other chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

This warning is provided pursuant to California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) and does not indicate a violation of any product safety standard.

15. Intellectual Property

All Site content (excluding Your Content) is the property of Dance’s Sporting Goods or its licensors.
This includes logos, images, text, and other intellectual property.

16. Limits

Any quantity limits indicated on product pages or carts are per customer per day unless otherwise stated.

17. Refunds

Refunds typically post within 5–7 business days.
Some banks may take longer to release funds.

18. Privacy & Electronic Communications

By using the Site, you agree to our Privacy Policy, including the collection and use of personal data.
You consent to receive communications electronically, which satisfy legal requirements for notices.

19. Third-Party Links

The Site may contain links to third-party websites.
Dance’s Sporting Goods is not responsible for content or practices of third-party sites.

20. Updates & Changes

Dance’s Sporting Goods may update these Terms at any time.
You are responsible for reviewing Terms regularly. Continued use of the Site constitutes acceptance of any changes.

21. Entire Agreement

These Terms constitute the entire agreement between you and Dance’s Sporting Goods regarding use of the Site, superseding prior agreements.

22. Mobile App

The Dance’s Sporting Goods mobile app (the “App”) is a companion to our website for browsing our catalog, checking order status, saving items and receiving alerts. These Terms apply to your use of the App.
Purchases. You can add eligible products to a cart in the App. When you check out, the App opens our website’s secure checkout with your cart, and the purchase is made on the Site under these Terms (payment, tax, shipping and all age, ID, FFL and state requirements are handled there). Firearms are never sold through the App’s cart; they can only be purchased on our website, and are shipped to a licensed dealer (FFL) or picked up in store after a background check. Some other items (such as ammunition and firearm accessories) may also be available only on our website.
Stock counts, prices and order information shown in the App are provided as available and may differ from the website or what is on our shelves (see Section 5, Inventory & Availability).
Notifications and alerts are optional, are provided as available, and are not guaranteed to be delivered on time or at all. You can turn them off at any time in the App or your phone’s settings.
Our Privacy Policy (Section 13) describes the information the App collects.
Deal codes. App-only deal codes are promotional offers. They may have start and end dates, usage limits and product exclusions, can be changed or ended at any time, cannot be combined with other offers unless stated, and have no cash value.
Shared wish lists. Anyone who has the link to a wish list you share can see it. Share links only with people you trust. Prices and availability shown are subject to change.

23. Brag Board (User Posts)

You must be signed in to post. By posting a photo or caption (“Post”), you confirm that you took the photo or have the right to share it, that everyone shown is comfortable with it being shared, and you grant Dance’s Sporting Goods the license described in Section 8 to display it in the App and on our channels.
Your first name and last initial are shown with your Post.
Not allowed: offers to sell, trade or transfer firearms or other regulated items; photos of other people’s children; unsafe firearm handling; illegal activity; hateful, harassing, threatening, sexual or graphic content; personal information about others; advertising or spam; or anything that infringes someone else’s rights.
Review and removal. Every Post is reviewed by our staff before it appears. We may decline or remove any Post, and suspend or ban any user, at our sole discretion, with or without notice. There is no tolerance for objectionable content or abusive users.
Reporting and blocking. You can report a Post, block a user, and delete your own Posts in the App. You can also email info@dancessportinggoods.com. We review reports and act on them promptly.
Posts are the opinions and content of the people who submit them and do not represent Dance’s Sporting Goods.

24. Read the Water

Read the Water shows water level, flow, temperature and tide information from public U.S. government and other third-party data sources.
Data is provisional, may be delayed or inaccurate, and is for general planning only. It is not a safety, navigation or flood warning service.
You are responsible for checking local conditions, weather, regulations and advisories, and for your own safety on and around the water, including wearing a life jacket.
Weather, sunrise and sunset, moon and solunar (best-time) information is provided for general planning only, may be inaccurate, and is not guaranteed. Hunting-hour information is a general guide, not legal advice: seasons, hours and rules vary by state, species and area, and you are responsible for knowing and following the laws that apply to you.

25. Reviews, Questions and Messages

Reviews, ratings and product questions you post (in the App or on the Site) are “Your Content” under Section 8 and are shown publicly with your first name and last initial. They must be honest, about the product, and follow the same rules as Brag Board posts in Section 23 (no offers to buy, sell or transfer firearms; no personal information; nothing illegal, hateful, graphic or abusive).
“Verified Buyer” means our records show you bought the product; it is not an endorsement. We may decline, hold, edit for formatting, or remove any review, rating or question at any time, including reviews that are inaccurate, off-topic or inappropriate. Answers from our staff are general information, not a guarantee of fit, performance or legality for your particular use or location.
Messages sent through “Ask the counter” are for general help. Don’t include serial numbers or other sensitive information. Answers about firearms, ammunition or accessories are not legal advice; you are responsible for following the laws that apply to you. We may archive conversations that need no reply and may delete conversations at any time; a deleted conversation is no longer available in the App. For anything about an order or a firearm transfer, please call us.
Accessory fit shown by the Accessory Finder or “Complete your setup” is based on manufacturer product descriptions and may not be exact for every model, generation or variant. Please confirm fit before you buy or ask us. Hunting and fishing spots come from public data, may be out of date, and do not mean hunting or fishing is allowed there; check with the managing agency.
Marking an order as picked up in the App is only available for orders that don’t require an ID check or FFL paperwork at pickup; please use it only after you have your order.
